1. Introduction and acceptance

These Terms of Service (these “Terms”) govern access to and use of Peek, an artificial-intelligence growth analyst, including its assistant, Vera (the “Service”), provided by Mosaic AI Technology Labs Ltd, a company incorporated in the Dubai International Financial Centre with registered number 14517 and registered office at IH-00-01-03-OF-05, Level 3, Innovation One, Dubai International Financial Centre, Dubai, United Arab Emirates (“Mosaic”, “we”, “us” or “our”). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you represent that you have authority to bind it, and “you” refers to both you and that business.

Where your business has signed a separate agreement with Mosaic for the Service, that agreement prevails over these Terms if they conflict. These Terms should be read with the Peek Privacy Policy (Section 6).

2. About the Service

Peek connects to tools your business already uses, such as its website enquiry forms, practice-management or sales records, advertising and analytics accounts, and WhatsApp and Instagram messaging, to trace each enquiry through to a visit and revenue, report on advertising performance and team responsiveness, and answer questions about that data. Peek reads data from the tools you connect. It does not send messages to your customers or change data in your other tools. Mosaic may add, change, suspend or discontinue any feature of the Service.

3. Eligibility and authorised users

The Service is available to individuals who are at least 18 years old and authorised by a business that has an account with Mosaic. You sign in with a Google account whose email address or domain your business has authorised. Keep your account secure and tell us promptly at info@mosaicsolutions.ai about any unauthorised use. Mosaic may suspend or end your access at any time, including when your authorisation or your business’s account ends.

4. Your responsibilities for the data you connect

Your business decides which data sources to connect and is the controller of the personal data about its customers, leads and patients that the Service processes. Your business is responsible for:

  • (a) having a lawful basis, and any consent or other condition the law requires, including for health information and for messaging and advertising data, to share that data with Mosaic for the purposes of the Service;
  • (b) giving its customers and patients any notice the law requires about this processing;
  • (c) connecting only accounts, systems and data it is entitled to share; and
  • (d) passing to Mosaic any instruction to correct or delete data.

5. Acceptable use

Use the Service only for legitimate business purposes and in line with these Terms, the Privacy Policy and applicable law. You must not:

  • (a) access data, accounts or systems you are not authorised to access;
  • (b) reverse engineer or attempt to derive the source code of the Service;
  • (c) use the Service or its output for unlawful, discriminatory or harmful purposes, or to make clinical decisions;
  • (d) interfere with or circumvent the security or performance of the Service;
  • (e) use the Service in breach of the terms of any platform it connects to, including Google’s terms and API policies, Meta’s Platform Terms, the WhatsApp Business Solution Terms and Meta’s policies; or
  • (f) share personal data with the Service beyond what your business has authorised.

6. Data handling and privacy

How Mosaic collects, uses, stores and shares personal data in connection with the Service is described in the Peek Privacy Policy at https://www.mosaicsolutions.ai/peek/privacy, which forms part of these Terms. For your business’s customer and patient data, Mosaic acts as your processor under a data processing agreement, as described in the Privacy Policy.

7. Intellectual property

Mosaic and its licensors own the Service, including its software, models, workflows, documentation and trademarks. Subject to these Terms, Mosaic grants you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your business’s purposes. Your business retains all rights in the data it connects and the content it submits (“Your Content”) and grants Mosaic the licence needed to host and process Your Content to provide, secure and support the Service, consistent with the Privacy Policy, including its commitment not to use Your Content to train generalised artificial-intelligence models.

8. Third-party services

The Service works with third-party services that your business connects or that Mosaic uses to provide it, including Meta (WhatsApp, Instagram and advertising), Google (sign-in, Sheets and Analytics), Anthropic (language processing), and your business’s own messaging and practice-management providers. Your use of those services is governed by their terms. Mosaic is not responsible for their availability, content or practices.

9. Disclaimers

THE SERVICE, INCLUDING ANY ARTIFICIAL-INTELLIGENCE-GENERATED OUTPUT, IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR UNINTERRUPTED OPERATION.

REPORTS, MATCHES, SCORES AND OTHER OUTPUT MAY BE INACCURATE OR INCOMPLETE, ARE NOT MEDICAL, FINANCIAL OR PROFESSIONAL ADVICE, AND MUST BE REVIEWED BEFORE YOU RELY OR ACT ON THEM.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOSAIC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THEIR POSSIBILITY.

This Section does not limit liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be limited by law.

11. Term, suspension and termination

These Terms apply while you use the Service. Mosaic may suspend or end access with or without notice, including if your authorisation ends, you breach these Terms, or Mosaic discontinues the Service. Sections 4, 6, 7, 9, 10 and 13 survive termination.

12. Changes to these Terms

Mosaic may update these Terms. Where a change is material, we will give reasonable notice before it takes effect. Continued use after a change takes effect means you accept it.

13. Governing law

These Terms and any matter arising from them, including non-contractual disputes, are governed by the laws of the Dubai International Financial Centre, and the DIFC Courts have exclusive jurisdiction.

14. General

These Terms, with the Privacy Policy and any signed agreement for the Service, are the entire agreement between you and Mosaic about the Service. If a provision is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver. You may not assign these Terms without Mosaic’s written consent; Mosaic may assign them in a merger, acquisition, reorganisation or sale of assets.
